This Legal Notice governs the access, browsing and use of the Web Site www.dcbsoftwareza.com (hereinafter, the Site). The provisions stated in this Legal Notice shall be deemed additional in the event that the Company established specific Conditions for the use and/ or hiring of certain services.

1. Right of information

In conformity with the provisions of the Electronic Communications and Transactions Act 25 of 2002 (ECT Act), we inform you that the Site is owned by DCB SOFTWARE SOUTH AFRICA (hereinafter, DCB SOFTWARE), a private company incorporated in accordance with South African legislation, with registered office at 1st Floor Sable Park, Bridgeway Century City, Cape Town, Western Cape, 7441, South Africa, with Registration Number 2026/293614/07 and Tax Number 9061392313, registered with the Companies and Intellectual Property Commission (CIPC) of South Africa. 2. Users

By accessing and/or using the Site you shall be regarded as a User thus legally bound by this Legal Notice.

3. Use of the Site

The User accepts the responsibility derived from the use of the Site. This responsibility also applies to the registry that might be necessary to access the Contents or Services offered by DCB SOFTWARE SOUTH AFRICA. The User commits himself to use, in an adequate manner, the Contents and Services offered by DCB SOFTWARE SOUTH AFRICA on the Site. The User must not use the Contents and Services with the purpose of:

  • (i) carrying out activities deemed illegal, unlawful or contrary to good faith and public order;
  • (ii) damaging the physical or logical systems property of DCB SOFTWARE SOUTH AFRICA, its suppliers or third parties;

4. Intellectual Property

DCB SOFTWARE SOUTH AFRICA is the holder of all Intellectual Property rights of its Site, together with all the elements containing (non-exhaustively) images, sounds, audio clips, video, software or texts; brands or logotypes, combinations of colours, structure and design, selection of used materials, computer programs required for its functioning, access and use, etc. All contents have reserved rights.

In conformity with the provisions of the Copyright Act 98 of 1978 (as amended) and the Trade Marks Act 194 of 1993, the reproduction, distribution and public communication, including the disposal of all or part of the Contents, with commercial purposes, in any format and by any technical means without the authorization of DCB SOFTWARE SOUTH AFRICA, shall be prohibited.

The User must respect all Intellectual Property Rights held by DCB SOFTWARE SOUTH AFRICA.

5. Responsibility and Guarantee

DCB SOFTWARE SOUTH AFRICA has adopted all the necessary measures that, within its means and the technological developments, allow a correct functioning of the Site and guarantee the absence of viruses and other harmful elements. Nevertheless, DCB SOFTWARE SOUTH AFRICA shall not be responsible for:

  • (a) the continuity and availability of Contents and Services;
  • (b) damages caused by any person infringing the security systems of DCB SOFTWARE SOUTH AFRICA.

DCB SOFTWARE SOUTH AFRICA may suspend temporarily and without previous notice, the accessibility to the Site due to maintenance, repair, update or improvement. In such case, the User would be notified in advance of the expected suspension date, provided that circumstances allow it.

DCB SOFTWARE SOUTH AFRICA shall not be responsible for any links to the websites of other companies available on the Site. These links may transfer the User to websites over which DCB SOFTWARE SOUTH AFRICA has no control. 7. Applicable Law and Jurisdiction

This Legal Notice is governed by South African law. Any disputes arising from or in connection with this Legal Notice shall be subject to the exclusive jurisdiction of the South African courts. Users may also seek recourse through the applicable consumer protection channels established under the Consumer Protection Act 68 of 2008.
